Personal Trust

The Trust Department of Regent Trust Company serves as Trustee for both living trust, trusts created by will and charitable trusts according to the following schedule.

  • Acceptance Fee
    Ordinarily, no acceptance fee is charged. However, if the nature of the assets involved requires extraordinary work in setting up proper records, of if the trust department is required to audit the account of a predecessor trustee, some additional compensation may be justified. In this event, a reasonable fee will be assessed, based on the actual work involved.

  • Base Fee
    The base fee is an annual charge, billed quarterly and applies to the fair market value of all assets (except oil and gas interests) held at the close of the accounting period. The base fee is calculated on the following basis:

    .96 of 1% on the first $400,000
    .71 of 1% on the next $600,000
    .46 of 1% on the balance

    Fees are prorated on partial years.

  • Base Fee Example For a trust account of $1,000,000 in market value the fee would be as follows:

    .96 of 1% on the first
    400,000        $3,840.00 .71 of 1% on the next
    600,000        $4,260.00

    $8,100.00

    Minimum Annual Fee $1,000

  • Distribution Fee
    A fee of 1% is charged on all distributions of principal in excess of income and at the time a trust terminates, or is transferred.

  • Oil and Gas Interests
    Collection and Distribution of Royalty Interests An annual minimum fee of $20.00 for each interest held, plus annual fee on the total income received by the account as follows:

    6% on the first $30,000
    4% on the next $20,000
    1% on all income over $50,000

  • Real Estate Interests
    The management and sale of real estate involves many factors. A fee will be charged in addition on base annual fee as follows:

  • Real Estate Management
    5% of total rents received on residential, business or farm properties.

  • Real Estate Sales
    3% of sales price if the Trust Department negotiates sale
    1% of sales price if real estate broker or other agent handles sale.

        Minimum Fee
    $50 annual fee per property

  • Strategic Asset Management Strategic Asset Management is available and is a separate annual charge, billed quarterly and applies to the fair market value of investment assets under management as follows:

  • Statements
    The Trust Department will render quarterly statements of each account at no charge. If monthly, or irregular statements are requested, a reasonable charge will be imposed.

  • Tax Returns
    Tax Returns will be prepared by outside accounts. All costs for such returns will be charged to the trust account.

  • Co-Trustee or Co-Personal Representative
    We welcome the opportunity to work with a co-trustee or co-personal representative of your trust or estate. However, since most of the responsibility for the management of the account remains with the trust department, the trust department does not split or share the fees set forth in this brochure.

  • Special Services
    Occasionally, the Trust Department is called upon to render services over and above those expected in ordinary trust or estate accounts. These extraordinary services may involve frequent personal conferences with beneficiaries or numerous account distributions. In these events, an extraordinary fee - based upon the nature of the service and responsibility involved - may be charged.

Managing Agent

Under a Managing Agent Agreement, the Trust Department will render investment counseling, provide supervision and safe keep assets, collect dividends, interest, rents, and income, make payments to principals, and distribute assets upon termination.

The Managing Agent fee is an annual charge, billed quarterly, based upon the fair market value of all assets and is calculated on the following basis:

.96 of 1% on the first $200,000
.71 of 1% on the next $400,000
.46 of 1% on the next $600,000
.375 of 1% on the balance.

Minimum Annual Fee $1,000

  • Distribution Fee
    A fee of 1% is charged on all distributions in excess of income and at the time an agency terminates.

Probate Proceedings
  (Personal Representative)

The Statutes of the State of Oklahoma fix the fee charged for acting as personal representative. This fee is a one-time cost, regardless of the length of time involved in the probate proceedings. It is based on the appraised value of the estate subject to probate, according to the following schedule:
5% on the first $1,000
4% on the next $5,000
2 1/2 % above $6,000

• Tax Returns
The preparation of estate tax returns, gift tax returns, and fiduciary income tax returns of the estate - as well as the decedent's final income tax returns - will be handled by tax specialists selected by the personal representative. Fees for the preparation of these returns will be charged to the estate.

Miscellaneous Services

  • Irrevocable Life Insurance Trusts
    The Trust Department serves as Trustee of irrevocable life insurance trusts, sometimes referred to as "Crummey Trusts." The Trustee is responsible for receiving annual gifts, notifying the beneficiaries of withdrawal rights and paying the insurance premium. The yearly fee is $200.

  • Under this arrangement, the trust department neither acts as trustee nor renders any investment advice. The trust department will provide safekeeping and custody service for bank clients. The fee is a charge of $75.00 for each transaction. The trust department assumes no liability for called or redeemed securities.
